These Terms of Use ("Terms") govern your access to and use of the Rooted in Equity website and our free, open-access educational programs (the "Services"), operated by Rooted in Equity ("we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Who may use the Services
Our content is open to everyone. If you are under the age of 18, you may use the Services only with the involvement of a parent, legal guardian, or educator. Accounts created on behalf of a minor must be set up and managed by a parent, legal guardian, or authorized educator.
Permitted use
Rooted in Equity provides free educational content for students, families, and educators. You may access, view, download, and use our lessons and resources for personal, classroom, and noncommercial community learning.
Prohibited use
You agree not to use the Services to: violate any law or the rights of others; copy, sell, or commercially exploit our content except as expressly permitted; upload or transmit harmful, unlawful, or abusive content; misrepresent your identity or affiliation; attempt to gain unauthorized access to any account or system; or interfere with, disrupt, or place undue load on the Services, including through automated scraping that degrades performance.
Accounts
If you create an account, you are responsible for keeping your login credentials confidential and for activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Content ownership and intellectual property
Unless otherwise noted, the content on the Services — including text, lessons, videos, graphics, and the Rooted in Equity name and logo — is owned by Rooted in Equity or used with permission and is protected by intellectual-property laws. We ask that you credit Rooted in Equity when you share our materials. All rights not expressly granted are reserved.
Your submissions
If you send us a message, feedback, or other content, you grant us permission to use it to operate and improve the Services and to respond to you. Please do not send us confidential information you do not wish us to use for these purposes.
Donations
Donations to Rooted in Equity are voluntary, support our programs, and never unlock or gate access to content. Donations are processed by a third-party payment provider subject to its own terms. Donations are generally non-refundable except as required by law; if you believe a donation was made in error, contact us.
Third-party services and links
The Services rely on third-party providers (for example, for hosting, accounts, email, donations, analytics, and embedded video) and may link to third-party websites. We do not control and are not responsible for third-party services or content, which are governed by their own terms and policies.
Disclaimer of warranties
The Services and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Educational content is offered in good faith for general informational purposes and is not a substitute for professional advice.
Limitation of liability
To the fullest extent permitted by law, Rooted in Equity and its directors, staff, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Services.
Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in North Carolina.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
